US District Court: Election Integrity Project California, Inc., et al. v. Alex Padilla, California Secretary of State, et al. was filed in US District Court, Central District of California, on January 4, 2021. The complaint sought declaratory and injunctive relief in relation to the November 3, 2020, General Election including a request to preserve paper ballots and all voting machines as well as a request to decertify the election results. The case was assigned to the Hon. Andre Birotte, Jr., a Democratic appointee. On January 5, 2021, Plaintiffs filed a Motion for Temporary Restraining Order which was denied on January 11, 2021. Plaintiffs filed an Amended Complaint on March 8, 2021, dropping the request to decertify the results of the election. Plaintiffs’ Amended Complaint was dismissed with prejudice on June 14, 2021. On August 30, 2021, the court entered a final judgment on the complaint.

US Court of Appeals: Plaintiffs filed an appeal of Judge Birotte’s decision in the US Court of Appeals for the Ninth Circuit on September 27, 2021. The appeal is pending as of January 17, 2022.

Issues: Voting machines (intentional fraud); Vote-by-mail (improper signature certification, illegal ballots added to results)

Outcome: The Plaintiffs lost.
